Preliminary Information Regarding the Contractual Process

The website www.canvidalet.com is owned by BODEGAS CAN VIDALET S.L., with Tax ID Number B57060808 and registered office at Carretera Alcudia Pollensa km 4.85, 07460, Huerta, La (Balearic Islands).

These General Terms and Conditions of Contract govern the distance sales relationship between BODEGAS CAN VIDALET S.L. and the User or Customer, in accordance with applicable laws, in particular:

  • Law 7/1998, dated April 13, on General Conditions of Contracting,
  • Law 3/2014, dated March 27, modifying the consolidated text of the General Law for the Defense of Consumers and Users,
  • Organic Law 3/2018, dated December 5, on the Protection of Personal Data and Guarantee of Digital Rights,
  • General Data Protection Regulation (EU) 2016/679 (GDPR),
  • Law 7/1996, dated January 15, on the Regulation of Retail Commerce, and
  • Law 34/2002, dated July 11, on Information Society Services and Electronic Commerce.

    BODEGAS CAN VIDALET S.L. reserves the right to make modifications to these Terms and Conditions at any time and without prior notice. Such modifications may be published via its website in any legally admissible manner and shall be binding while they remain published until validly replaced by subsequent modifications. However, BODEGAS CAN VIDALET S.L. also reserves the right to apply, in specific cases and with appropriate prior notification, Special Contracting Conditions that take precedence over these General Terms and Conditions when deemed appropriate.

    The purpose of the website is the sale of wines and spirituous beverages.

    The contract term is linked to the delivery of the product without prejudice to the Right of Withdrawal.

    As a user or customer, you expressly declare to know, understand, and accept the terms of use and these General Terms and Conditions of Contract. Likewise, you declare that you are of legal age and possess the necessary legal capacity and competence to access the BODEGAS CAN VIDALET S.L. website and enter into contracts through it.

    To purchase our products, please visit the respective section of our online store.

    You may register as a website user to purchase online in the designated section on the website. In accordance with applicable data protection laws, BODEGAS CAN VIDALET S.L. informs users that personal data collected during registration and subsequent purchases will be incorporated into BODEGAS CAN VIDALET S.L.’s processing system, solely for processing these requests and managing subsequent related actions.

    Your data will be retained only for the time strictly necessary to fulfill these purposes, unless a legal retention obligation applies.

    We inform you that the legal basis for processing your data is the proper execution of the contract between the parties and your consent.

You may also address the competent supervisory authority to file any complaints.

    During the purchase process, you must identify yourself with the username and password provided. These credentials are confidential and will not be made public. You are responsible for treating your login credentials confidentially and responsibly and for not transferring them to others. You may modify your registered information at any time within your client area. This section also provides access to your order history, which is for consultation and management only; you may delete records you no longer wish to view.

    Upon completion of the purchase process, the customer will receive confirmation by email. It is essential to provide a valid email address during the purchase.     All website content is available in Spanish, English, and German.

    Upon delivery of the product to the provided shipping address, the customer will receive an invoice or a copy of the order.

    Offers and Validity

    In the case of a product on sale, the offer price and its validity period will always be clearly indicated alongside the product’s essential characteristics.

    In compliance with applicable law, BODEGAS CAN VIDALET S.L. provides full information about all articles for sale, including their characteristics and prices. However, BODEGAS CAN VIDALET S.L. reserves the right to remove, replace, or change the products offered on its website by means of simply updating the website content.

    Accordingly, the products offered at any given time on the website will be subject to the prevailing General Terms and Conditions of Contract. Furthermore, the company may discontinue offering access to such products at any time and without prior notice.

    Essential Characteristics of the Products

    The products offered in our online shop include a photograph and essential characteristics taken from the manufacturer.

    The color of the product as seen in the photograph is indicative and not binding. The product characteristics define its true attributes.

    Warranties

    All products offered on the website come with the commercial warranty of their respective supplier. BODEGAS CAN VIDALET S.L. provides after-sales service while the warranty is valid; customers may exercise this warranty by contacting BODEGAS CAN VIDALET S.L. either in person, by email at info@canvidalet.com, or through the supplier’s established service points.     For perishable products received in poor condition or expired, please contact info@canvidalet.com immediately. It is essential to follow the preservation instructions indicated on the packaging, respect expiry dates, and retain the proof of purchase in all cases.

    Prices

    All products indicate the selling price in Euros and include Value Added Tax (VAT).

    If any other tax is applicable (such as IGIC or IPSI), this will be stated accordingly.

    Delivery and Shipping Costs

    Estimated delivery times are approximately:

    • 1 to 7 business days for Mallorca,
    • 5 to 10 business days for deliveries to the Spanish mainland, and
    • Up to an additional 7 to 20 business days for other European destinations.

    Please note the following:

    • If payment is confirmed Monday to Friday, the first business day is the day you receive the payment confirmation by email along with the invoice; from this day the delivery time starts.
    • If payment is confirmed on a Saturday, Sunday, or public holiday, delivery time begins the next business day after payment confirmation.
    • Only orders placed before 5:00 p.m. are considered as placed on the same day; orders placed after 5:00 p.m. will count towards delivery time starting the next business day.
    • Shipping costs depend on the destination and will be calculated during the purchase process and communicated to you at checkout before payment.

    Payment Methods

    You may pay for your order using any of the following methods, which you must select during the purchase process:

    • Visa or MasterCard Credit Card

    All transactions involving the transmission of personal or banking data are conducted in a secure environment using SSL (Secure Sockets Layer) technology. Your information is transmitted encrypted.

    Credit card details are entered directly on the bank’s payment portal (Redsys Virtual POS) and are neither entered on nor stored by BODEGAS CAN VIDALET S.L.’s servers. Payments connect directly to the Redsys electronic payment platform: https://sis.redsys.es/sis/realizarPago.

    When paying by Visa or MasterCard, you will be asked for the card number, expiry date, and Card Verification Code (the last three digits printed on the back of your card), providing increased transaction security.

    This payment method is valid only via the website.

    If a charge is made fraudulently or improperly using your card number, you may demand immediate cancellation of the charge. Corresponding debit and credit entries will be promptly made to the accounts of the provider and cardholder.

    If the purchase was legitimately made by you and the refund claim is not the result of exercising the right of withdrawal or rescission, you will be liable to compensate BODEGAS CAN VIDALET S.L. for damages caused by the cancellation.

    • PayPal

    PayPal allows secure and convenient internet payments, building upon existing banking and credit card infrastructure to create a global real-time payment solution. It is especially convenient for those dissatisfied with traditional payment methods.

    Order Execution

    Product availability may vary depending on customer demand. While BODEGAS CAN VIDALET S.L. periodically updates stock, the requested product may be out of stock when you order.

    If the order cannot be fulfilled due to unavailability, BODEGAS CAN VIDALET S.L. will notify the customer by email immediately upon learning of the situation, within a maximum of 30 calendar days.

    BODEGAS CAN VIDALET S.L. may offer the customer either:

    • A substitution product of similar or better quality at no extra cost, or
    • A refund of all sums paid for the cancelled order, except for justified and demonstrable reasons.

    Right of Withdrawal

    Consumers have the right to withdraw from the contract within fourteen (14) calendar days from the day the product is received, without penalty and without specifying reasons.

    According to Article 103 of Law 3/2014, March 27, modifying the consolidated text of the General Law for the Defense of Consumers and Users, supplies of goods made to consumer specifications, customized goods, or goods that cannot be returned due to their nature (e.g., perishable or rapidly deteriorating products) are exempt from the right of withdrawal.

    Returns

    The Customer must return or hand over the product directly to BODEGAS CAN VIDALET S.L. at Carretera Alcudia Pollensa km 4.85, 07460, Huerta, La (Balearic Islands), without undue delay and in any case no later than fourteen (14) calendar days after exercising the right of withdrawal. The deadline is considered met if the product is returned before expiration of the period.

    Customers bear the cost of returning the product.

    Refund of Payment

    Refunds will be made using the same payment method used by the customer for the original transaction unless expressly agreed otherwise.

    BODEGAS CAN VIDALET S.L. may withhold the refund until receipt of the product or proof of its return, whichever occurs first.

    Return of Defective Products

    If the product is received defective or in improper condition for reasons not attributable to the customer, the customer has the right to return the product free of charge by notifying BODEGAS CAN VIDALET S.L. via any channel provided in these Terms.

    Such return for defect or damage does not constitute withdrawal but a warranty claim.

    BODEGAS CAN VIDALET S.L. undertakes to cover return shipping costs and will replace the product with a new one under the conditions accepted at sale.

    Jurisdiction

    BODEGAS CAN VIDALET S.L. reserves the right to pursue civil or criminal actions it deems appropriate for improper use of its website, contents, or violations of these Terms.

    The relationship between the user and the provider is governed by Spanish law. Any disputes shall be subject to arbitration or ordinary jurisdiction complying with jurisdictional rules. BODEGAS CAN VIDALET S.L.’s domicile is in the Balearic Islands, Spain.

    Extended Information Regarding the Right of Withdrawal

    Withdrawal Form Clause

    Pursuant to applicable data protection regulations, you are informed that personal data obtained through this withdrawal form will be processed under the responsibility of BODEGAS CAN VIDALET S.L. to process your withdrawal right pursuant to Law 3/2014 of March 27 and other applicable laws.

    You may exercise rights of access, rectification, restriction, deletion, portability, and objection to the processing of your personal data and consent by addressing your request to Carretera Alcudia Pollensa km 4.85, 07460, Huerta, La (Balearic Islands), or via email at info@canvidalet.com.

    You may also submit complaints to the competent supervisory authority.

    Submitting this form formalizes your right of withdrawal and accordingly terminates the contractual obligations between the parties. Upon processing your request, BODEGAS CAN VIDALET S.L. will send you an acknowledgment of receipt by the communication channel you indicate in the form.

    Please keep the acknowledgment as proof of exercise of your withdrawal right.
